1. Owner identification

These Terms and Conditions of Use (the "Terms") govern access to and use of Stream Hatchet Creator (the "Platform" or the "Service"), owned by Stream Hatchet, SLU, a company incorporated in Spain, with Tax ID / CIF B98820913, and registered office at Cloudworks Casa de les Punxes, Avenida Diagonal 420, Barcelona, Spain. Company registration details: Barcelona Commercial Registry, Volume 46058, Folio 68, Sheet B-508166.

Stream Hatchet may operate the Platform directly or through companies within its corporate group, technical service providers and other third parties required to provide the Service, in each case in accordance with these Terms and the applicable Privacy Policy.

2. Purpose of the Service

The Platform is a web application for the analytics, measurement and professional presentation of content creator profiles. Its main purpose is to enable creators to view metrics from different streaming platforms and social networks in a single environment, generate or share a digital media kit and, where applicable, allow managers, agents or agencies to monitor certain data relating to creators under their management.

The Platform may include, among other things, the following features:

  • account registration and sign-in by email, magic link or OAuth with third-party platforms;
  • claiming or linking creator profiles;
  • connection of Twitch, YouTube/Google, Instagram/Meta, TikTok, X/Twitter, Kick or other compatible platform accounts;
  • viewing dashboards, metrics, trends, rankings, categories, games, creators and reports;
  • generation of proprietary metrics, estimates, scores, growth rollups and classifications;
  • access by managers, agents or agencies to creator profiles where they have sufficient authorization;
  • sale of, or access to, reports.

3. Acceptance of the Terms

By accessing, registering for or using the Platform, the user confirms that they have read and accepted these Terms, as well as the Privacy Policy, the Cookies/SDKs Policy and any specific terms applicable to particular features, reports, paid plans or promotions.

Where the user uses the Platform on behalf of a company, agency, manager, brand or other entity, the user represents that they have authority to bind that entity. Otherwise, the user must not use the Platform on behalf of any third party.

If the user does not accept these Terms, the user must not access or use the Platform.

4. Users, minimum age and capacity

The Platform is intended for users who are at least 18 years old. The user represents that they are at least 18 years old and have sufficient legal capacity to accept these Terms. If Stream Hatchet detects that an account has been created by a person who does not meet the minimum age requirement, the Platform may suspend or delete that account.

The Platform may be used by creators, managers, agents and agencies and, on a passive or limited basis, by brands or other recipients of public or aggregated information.

Where the user acts as a manager, agent, employee or representative of a creator or entity, the user represents that they have sufficient authorization to act on that person or entity's behalf, access their data, link profiles or consult metrics. The Platform may request reasonable evidence of such authorization and may suspend access where there are reasonable grounds for doubt.

5. Registration, account and security

5.1 Account creation

To use certain features, the user must create an account. The Platform may allow registration by email and password, magic link or authentication with external providers through OAuth. The user must provide accurate, up-to-date information and must not impersonate any third party.

5.2 Credentials and access

The user is responsible for maintaining the confidentiality of their credentials, sessions, access links and devices. The user must promptly notify Stream Hatchet of any unauthorized use or suspected compromise of their account.

5.3 External accounts

The user may link one or more external accounts from compatible platforms. Linking will be carried out through the mechanisms authorized by each platform, including OAuth, official APIs or ownership-verification methods. The Platform does not request, and should not receive, passwords for external platforms.

The user may unlink external platforms through the features available in their account. Unlinking may stop future synchronization, but it will not necessarily and automatically delete all historical information already obtained, which will be governed by the Privacy Policy and the applicable retention policy.

6. Operation of data, metrics and profiles

6.1 Data sources

The Platform may obtain data from the following sources:

  • data provided directly by the user, such as name, role, biography, country, language, interests, image, links, partnerships or profile settings;
  • data obtained through official APIs, OAuth, webhooks or authorized mechanisms of external platforms;
  • public or technical data associated with creator profiles, including handles, avatar, followers, views, posts, streams, games, clips or equivalent content;
  • metrics, estimates, classifications, trends, scores or indicators generated internally by the Platform from first-party or third-party data.

6.2 Estimated nature of the metrics

Metrics, scores, rankings, comparisons, trends, growth estimates, revenue estimates, affinities, brand-safety gauges and other indicators may differ from the official data published by the source platforms. The Platform uses reasonable efforts to keep data current and coherent, but does not warrant that it will be complete, accurate, permanent, audited or fit for any particular purpose.

The user acknowledges that the availability, quality, granularity and updating of metrics depends on external platforms, the permissions granted, quota limits, API changes, token availability and the user's own settings.

6.3 Claimed and unclaimed profiles

The Platform may allow certain creator profiles to exist as unclaimed profiles or as profiles generated from public or authorized data. The creator may initiate a claim or verification process in accordance with the methods then available, which may include OAuth, cross-platform matching, codes in biographies, manual review or other reasonable mechanisms.

6.4 Access by managers, agents and agencies

Managers, agents or agencies may access creator data only where they have sufficient authorization from the creator or a valid contractual basis. A user acting as manager will be responsible to the Platform and to the creator for any unauthorized access, misuse or false statement regarding their mandate.

7. Reliance on external platforms and API terms

The Platform depends on third-party services, APIs, SDKs, OAuth, webhooks, documentation, quotas and policies, including those of Twitch, YouTube/Google, Meta/Instagram, TikTok, X/Twitter, Kick, IGDB and other providers. Use of the Platform does not replace or amend the applicable terms of those platforms.

The user acknowledges that:

  • the Platform must access data only through permitted channels and with the permissions required for the features actually provided;
  • external platforms may modify, limit, suspend, revoke or discontinue APIs, permissions, quotas, endpoints, available data or usage requirements;
  • the Platform may stop displaying or synchronizing data where the user revokes permissions, a token expires, the platform removes or limits content, quotas are exceeded or there is a legal or contractual obligation to remove the data;
  • certain data obtained from external platforms may be subject to restrictions on storage, redistribution, resale, advertising, targeting, attribution, deletion, caching, commercial use or combination with other data;
  • the Platform may adapt, limit or suspend features in order to comply with API terms, protect security or prevent infringements.

The Platform is not affiliated with, sponsored by or endorsed by Twitch, YouTube/Google, Meta/Instagram, TikTok, X/Twitter, Kick or any other platform unless expressly stated in writing. Any use of third-party marks, names or logos will be solely for identification, attribution or interoperability purposes and in accordance with applicable guidelines.

8. Rules of use and prohibited conduct

The user undertakes to use the Platform lawfully, diligently and in good faith, and in accordance with these Terms, applicable law and the terms of the connected external platforms.

The following are prohibited:

  • scraping, mass extraction, unauthorized crawling or systematic harvesting of data outside the features expressly permitted;
  • use of bots, abusive automation, scripts, hacks, exploits or mechanisms intended to manipulate metrics, rankings, claims or results;
  • resale, licensing, redistribution, syndication or monetization of data, profiles, metrics, reports or content obtained through the Platform without express authorization;
  • use of the Platform for spam, unsolicited mass contact, unauthorized advertising profiling, external targeting or the creation of databases of individuals for impermissible purposes;
  • impersonating creators, managers, brands, agencies, employees, external platforms or any other third party;
  • accessing accounts, profiles, dashboards or metrics without sufficient authorization;
  • infringing intellectual property rights, image rights, privacy, honor, confidentiality or any third-party rights;
  • reverse engineering, decompiling, interfering with the Service, circumventing security measures, or manipulating APIs, tokens or control mechanisms;
  • attempting to exceed usage limits, quotas, rate limits or technical restrictions;
  • using the Platform in any manner that could harm the availability, security, reputation or integrity of the Service or of external platforms.

Any breach of these rules may result in suspension, limitation or closure of the account, removal of content, revocation of access, blocking of features, notification to external platforms or competent authorities, and claims for damages where appropriate.

9. User content, materials and licences

The user retains any rights they may hold in the content, images, stage names, avatars, logos, biographies, links, materials or information that they provide to the Platform or authorize to be imported from third parties, without prejudice to the rights of the source platforms and other third-party rights holders.

The user grants Stream Hatchet a non-exclusive, worldwide, royalty-free licence, sublicensable to providers as necessary to operate the Service, limited to hosting, technically reproducing, adapting formats, displaying, communicating, distributing within the Platform, and including such materials in media kits, dashboards, profiles, rankings, aggregated reports or equivalent features, to the extent necessary to provide the Service, improve its operation, comply with legal obligations and defend claims.

The licence will end when the user deletes the content or closes the account, except in respect of technical copies, aggregated or anonymized information, data that must be retained for legal, security, audit or claims-defense purposes, or restrictions arising from external APIs.

The user represents and warrants that they have sufficient rights, permissions and authorizations in and to the content and data that they provide, connect or authorize to be processed, including any stage name, image, trademarks, logos, biographies, representation data or any third-party materials.

10. Reports, paid plans and commercial terms

The Platform is free in its initial version, but may include freemium features, paid reports, premium plans, in-webapp purchases or additional services subject to specific commercial terms.

When paid features are enabled, before purchase the user will be informed of the main characteristics of the service or report, the price, applicable taxes, duration, payment method, access conditions, refunds, cancellation, support and, where applicable, any withdrawal right or exceptions to it.

Paid reports or analyses are provided on the basis of the data available at the time they are generated. Unless expressly stated otherwise, they do not constitute financial, legal, tax, commercial, investment or employment advice, nor any guarantee of opportunities, sales, sponsorships, campaigns or results.

11. Privacy, cookies and security

The processing of personal data is governed by the Platform's Privacy Policy, which explains in clear terms what data is processed, what it is used for, how long it is retained and how applicable rights may be exercised.

The use of cookies, SDKs and similar technologies is governed by the Platform's Cookies/SDKs Policy.

The Platform applies reasonable technical and organizational measures to protect data and user accounts, without prejudice to the risks inherent in any digital environment or third-party service.

12. Availability, technical changes and maintenance

The Platform is provided "as is" and "as available". Stream Hatchet will use reasonable efforts to keep the Service operational, secure and up to date, but does not warrant that it will operate without interruption or errors, or that it will be compatible with all systems, devices, browsers, platforms or third-party services.

The user acknowledges that operation of the Platform may depend on external providers, third-party APIs, quota limits, technical changes, maintenance work, network incidents, security measures or other circumstances outside Stream Hatchet's reasonable control.

Stream Hatchet may modify, suspend, withdraw or limit Service features where necessary for technical, legal, commercial, security, regulatory-compliance, API-compliance or Platform-improvement reasons.

13. Liability and warranties

The Platform is provided as a technological, analytical and informational tool. Unless Stream Hatchet expressly states otherwise in writing, Stream Hatchet does not act as representative, agent, intermediary, marketplace, adviser, auditor, guarantor or party to any commercial relationships, campaigns, agreements, sponsorships, collaborations or contracts that may be entered into among creators, managers, agencies, brands or other third parties.

The metrics, rankings, reports, estimates, trends, classifications, profiles, media kits, visualizations and data available on the Platform are informational and analytical in nature. They do not constitute an official certification of audience, performance, revenue, commercial value, campaign eligibility or any guarantee that commercial opportunities will be obtained. Stream Hatchet does not warrant that such information is accurate, complete, permanent, audited, updated in real time or suitable for any particular purpose.

The user is responsible for verifying the information before using it in negotiations, contracting, offers, campaigns, valuations, economic decisions or dealings with third parties. The user is also responsible for ensuring that the information, data, content, images, names, aliases, handles, links, trademarks, logos, profiles or accounts that the user provides, connects, claims, manages, publishes or uses through the Platform are truthful, accurate, up to date, lawful and do not infringe third-party rights.

Where the user acts as a manager, agent, agency, representative or on behalf of a third party, the user represents that they hold the authorizations, powers, mandates, licences, consents or legal bases necessary to do so. Stream Hatchet will not be liable for claims arising from insufficient authorization, impersonation, improper claiming of profiles or unauthorized use of third-party accounts, data or content.

Unless a mandatory legal obligation provides otherwise, Stream Hatchet will not be liable for errors, delays, limitations, suspensions, changes or unavailability of external platforms, APIs, OAuth, webhooks, providers, networks, devices or third-party systems.

Stream Hatchet will also not be liable for loss of commercial opportunities, campaigns, brand deals, revenue, expected profits, reputation or data where such loss derives from external, estimated, incomplete, outdated information or information subject to change by third parties.

Likewise, Stream Hatchet will not be liable for misuse of accounts or credentials, or for the third-party content, images, names, trademarks, logos, profiles, accounts, links or materials connected, claimed, published, shared or provided by users.

Stream Hatchet will not be liable for decisions made by brands, agencies, clients, creators, managers, advertisers, sponsors or other third parties on the basis of dashboards, rankings, reports, metrics, profiles, searches or media kits.

Stream Hatchet will also not be liable for relationships, communications, negotiations, contracting, campaigns, sponsorships, collaborations, payments, delivery of services, claims, breaches or disputes that may arise between users of the Platform or between users and third parties. Any agreement reached between them will be the exclusive responsibility of the parties involved.

The appearance of any creator, streamer, brand, agency, manager, advertiser, sponsor, client, profile or account on the Platform, and its inclusion in rankings, searches, categories, reports, dashboards, media kits or similar features, does not imply any recommendation, validation, audit, certification, endorsement, guarantee of authenticity, guarantee of quality, guarantee of audience, guarantee of revenue or commitment to contract by Stream Hatchet.

The user shall indemnify and hold harmless Stream Hatchet from and against any claim, damage, loss, cost, sanction, fine, compensation, expense, proceeding or liability arising from the improper, unlawful, unauthorized, fraudulent, abusive or negligent use of the Platform; breach of these Terms; information, data, content, profiles, accounts or materials provided or used by the user; infringement of third-party rights; lack of sufficient authorization to act in relation to a creator, brand, agency, manager, client or third party; or breach of the terms, policies, permissions, restrictions or requirements of external platforms.

Nothing in these Terms excludes or limits Stream Hatchet's liability where such exclusion or limitation is not permitted by applicable law, in particular in relation to non-waivable consumer rights, wilful misconduct, gross negligence, personal injury or legal breaches that cannot be limited.

14. Suspension, account closure and termination

14.1 Voluntary account closure

The user may request or complete the closure of their account through the features available in the dashboard or by writing to the support channel indicated. Account closure will result in loss of access to the dashboard and to the features associated with the account.

14.2 Effects on profiles and data

Deletion of the account may unlink the user from the creator profile, revoke tokens from external platforms, close sessions and stop future synchronizations. Certain public, historical, aggregated or anonymous information, or information necessary for security, compliance, audit or claims-defense purposes, may be retained in accordance with the Privacy Policy.

14.3 Suspension for breach

Stream Hatchet may suspend, limit or cancel an account where there are reasonable indications of fraud, impersonation, manipulation of metrics, unauthorized access, infringement of third-party rights, breach of these Terms, breach of external platform terms, security risk or abusive use of the Service.

Where reasonable, the user will be informed of the measure taken and of the channels available to submit observations. However, the Platform may act without prior notice where necessary to prevent harm, fraud, legal infringements, security breaches or API breaches.

15. Communications

The Platform may send operational communications necessary for the functioning of the Service, including messages relating to registration, authentication, security, account changes, verification, notices of platform connection or disconnection, incidents, support, updates to the Terms or legal information.

Commercial communications, newsletters, promotions or information about new features will be sent only where there is a valid legal basis, and the user may unsubscribe or object in accordance with applicable law.

16. Intellectual and industrial property

The Platform, its software, code, structure, design, interface, documentation, features, dashboards, reports, methodologies, internal metrics, scores, classifications, know-how, trademarks, logos and proprietary materials belong to Stream Hatchet or its licensors.

Use of the Platform does not transfer to the user any intellectual or industrial property right in the Platform or in Stream Hatchet's proprietary materials, other than a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable licence to access and use the Service in accordance with these Terms.

Data, content, metrics, names, images, avatars, handles, trademarks, logos, posts, videos, statistics, API data or materials from third-party platforms, such as Twitch, YouTube/Google, TikTok, X/Twitter, Meta/Instagram, Kick or other external sources, will continue to belong to their respective owners or remain subject to the applicable terms, licences, permissions, restrictions and policies of those platforms.

Stream Hatchet does not claim ownership of third-party data or content obtained, displayed, synchronized or processed through APIs, OAuth, webhooks or other authorized mechanisms. However, Stream Hatchet may use, organize, normalize, combine, analyze, visualize and present such data to the extent necessary to provide the Service, generate metrics, dashboards, rankings, profiles, media kits, analyses or reports, always within the limits permitted by applicable law and by the terms of the relevant platforms.

Derived metrics, aggregations, methodologies, classifications, scores, visualizations, reports and analyses generated by Stream Hatchet from first-party data, data provided by users or data obtained from external sources form part of Stream Hatchet's proprietary materials, without prejudice to the rights belonging to the holders of the underlying data, content or materials.

The user may not copy, extract, reuse, resell, redistribute, sublicense, communicate, exploit, scrape, create parallel databases from, train models on, reverse engineer or use the Platform, its materials, metrics, reports, dashboards or data accessible through the Service outside the uses expressly permitted in these Terms, on the Platform or under applicable third-party terms.

Where the Service displays trademarks, names, logos, icons, content or references to third-party platforms, such display is solely for identification, informational, attribution or interoperability purposes, and does not imply sponsorship, association, authorization, certification or endorsement by those platforms unless expressly stated otherwise.

17. Third-party services and marks

The Platform may display third-party names, trademarks, logos, identifiers, APIs, data, links or references for purposes of interoperability, source identification, attribution or functional description. Those signs belong to their respective owners.

The user must not interpret the presence of those elements as evidence of any affiliation, sponsorship, certification, approval or collaboration between the Platform and the relevant third parties unless expressly stated in writing.

18. Changes to the Terms

Stream Hatchet may amend these Terms for legal, technical, operational, commercial or security reasons, or due to changes in features, providers or the terms of external platforms. Material amendments will be communicated by reasonable means, such as email, a notice on the Platform or a dashboard notification.

If the user does not accept the new Terms, the user must stop using the Platform and may request account closure. Continued use after the changes take effect will constitute acceptance of the updated version, without prejudice to any non-waivable consumer rights.

19. Governing law, jurisdiction and consumers

These Terms will be governed by Spanish law, unless another law applies mandatorily by reason of the user's domicile or status.

Where the user acts as a business, professional, agency, manager, brand or entity in the course of their economic activity, the parties may submit any dispute to the courts and tribunals of Spain, waiving any other forum that might otherwise apply, provided that such waiver is valid.

Where the user qualifies as a consumer, nothing in these Terms limits the non-waivable rights granted to the user by applicable law. In such case, jurisdiction will be determined by the applicable consumer-law rules.
